General travel conditions de-ruimte

APPLICABLE GENERAL TERMS AND CONDITIONS DE-RUIMTE AMSTELVEEN

Introduction

De-ruimte Amstelveen offers pre-arranged trips under its own name as a travel organizer and/or travel agent. In these cases, a travel agreement is established between de-ruimte and you (see also article 8).


ARTICLE 1 DEFINITIONS

In these General Terms and Conditions the following definitions apply:

1.1. "De-ruimte Amstelveen":

a company based and operating in Amstelveen, registered with the Chamber of Commerce under number 34 32 75 32. De-ruimte acts as a travel organizer.


1.2. "Travel organizer":

When de-ruimte offers the public or groups pre-arranged (package) trips under its own name, it acts as a travel organizer.


1.3. "Travel agent":

If de-ruimte advises, informs, and mediates in forming agreements between the traveler and suppliers of (touristic or other) services, such as booking accommodations, transport, dining, or other individual services, it acts as a travel agent (intermediary/booking office). In this role, de-ruimte acts not under its own name but as an intermediary or contractor in the sense of Article 7:400 of the Dutch Civil Code.


1.4. "Custom trip":

If de-ruimte, whether or not at the client's request, assembles a package trip as defined in Article 7:500 of the Dutch Civil Code and offers it under its own name, this may constitute a travel agreement where de-ruimte acts as travel organizer.


1.4. "Traveler":

The client who is party to the travel organizer, or the person on whose behalf the trip is booked (the fellow traveler) and who has accepted the booking on their behalf.


1.5. "Travel agreement":

The agreement as referred to in Article 7:500 of the Dutch Civil Code, where de-ruimte commits to providing a pre-arranged (package) trip that includes an overnight stay or a period longer than 24 hours and at least two of the following services: a. transport; b. accommodation; c. another significant (tourist) service or provision related to the trip.


1.6. "Service provider":

The carrier such as a coach company or airline, or other service providers like accommodation providers (hotels and/or hosts), travel organizers and/or other travel-related service providers with whom the traveler concludes an agreement through the travel agent's mediation. The service provider is responsible for delivering these services. De-ruimte is not liable unless it has committed itself as travel organizer under its own name for a package trip.


ARTICLE 2 APPLICABILITY OF GENERAL TERMS AND CONDITIONS

2.1 These General Terms and Conditions of de-ruimte apply to all offers, proposals, travel agreements, and contracts where de-ruimte is a party. These terms include limitations of liability.


2.2 When de-ruimte acts as a travel agent (booking office) mediating bookings of accommodation, transport, or other tourist services, these General Terms and Conditions apply to the mediation, including Article 7, which contains liability limitations for de-ruimte as travel agent/booking office.


2.3 When de-ruimte acts as a travel organizer, particularly by offering a so-called package trip under Article 7:500 of the Dutch Civil Code, these General Terms and Conditions apply alongside the relevant legal provisions, especially Article 8, which includes liability limitations for de-ruimte.


ARTICLE 3 FORMATION AND CONTENT OF THE AGREEMENT

3.1.1 De-ruimte's offers are non-binding and may be revoked if necessary. Revocation due to errors in pricing or other mistakes is permitted and must occur within 48 hours after acceptance, stating reasons.


3.2 By accepting the offer and accompanying terms of de-ruimte, a binding agreement is formed. The traveler will receive an electronic confirmation of the booking.


3.3 De-ruimte may refuse a booking or exclude a traveler during a trip without explanation, for example due to misconduct or behavior that negatively impacts other participants or guides.


3.4 When the traveler engages de-ruimte as travel agent for booking accommodations, transport, or other tourist services between the traveler and the service provider, this constitutes an assignment as defined in Article 7:400 of the Dutch Civil Code. The traveler is bound to this assignment, regardless of whether confirmation is provided. Any fees charged by de-ruimte for its services will be disclosed in advance.


3.5 If the travel agent incurs obligations toward third parties on behalf of the traveler, the traveler is bound by these obligations.

3.6 The traveler is jointly and severally liable for fulfilling all obligations toward de-ruimte and involved service providers arising from the agreement or assignment. Other traveling companions are liable only for their share toward the travel agent, organizer, or service providers.


3.7 No rights can be derived by the traveler from amounts or other information on the website, brochures, confirmations, or other materials of de-ruimte. Travelers should verify all information on the confirmation themselves.


3.8 Obvious errors or mistakes in the travel offer do not bind de-ruimte. These are errors that would be apparent to the average traveler at first glance.


3.9 When booking or concluding the agreement, the traveler must provide all relevant information about themselves and fellow travelers. De-ruimte is not liable for consequences of incomplete or incorrect information; any resulting costs are the traveler's responsibility. For personal data, de-ruimte follows Dutch standards and requires relevant information that may affect the trip's execution, including physical or mental conditions or other relevant circumstances.


3.10 Participants must be in good physical and mental health and condition. If in doubt about suitability, travelers should email us. Failure to comply may result in exclusion from the trip without refund.


3.11 Prices of reserved/booked services may change according to the service provider's terms. Changes will be communicated and charged to the traveler as soon as possible.


3.12 Cancellations or changes to agreements can only be made at the traveler's request. Costs related to cancellations or changes will be charged accordingly. Cancellation must be confirmed in writing (de-ruimte Amstelveen, Kostverlorenweg 1d, 1183TM Amstelveen) and by email (info@de-ruimte.net). The postmark date is the cancellation date. Due to the complexity of organizing trips, cancellation fees apply as follows:

· Upon booking confirmation: full deposit as specified per trip

· 6 to 4 weeks before departure: 50% of the trip price;

· 4 to 2 weeks before departure: 75% of the trip price;

· 2 weeks to departure day: 100% of the trip price.

If cancellation occurs at any time after de-ruimte confirms the trip, 100% of flight ticket costs will be charged if included. Changes can be requested up to 4 weeks before departure and may be accepted by service providers. Change fees will be charged. If the trip or part is transferred to a third party (another Dutch or foreign travel organization, independent organizer, or accommodation provider), the third party's change conditions apply first.


3.13 All communications from de-ruimte or service providers will be addressed solely to the traveler.


3.14 For trips including transport, when travel and stay durations are listed in days, the departure and arrival days count as full days regardless of time. This may result in actual stay being shorter than stated.


3.15 Some trips require a minimum number of participants; if this number is not met, the trip may be canceled. The cancellation deadline is 14 days before departure. The minimum participant number is listed with the trip. De-ruimte may terminate the agreement immediately if minimum numbers are not met.


3.16 If minimum participation is not reached, de-ruimte will try to proceed to avoid disappointment. Options may include:

• Carrying out the trip with a price increase

• Offering an alternative departure date

• Offering an alternative trip

• A combination of these options.


3.17 Local conditions and unique destinations may require itinerary changes before or during the trip. Changes due to prolonged bad weather are also possible. Such adjustments may alter routes, excursions, accommodations, and local transport from those published. De-ruimte and its providers will offer alternatives preserving the trip's character as much as possible. Travelers may only reject changes if no reasonable alternative exists and the change causes significant disadvantage. These changes do not affect the price unless agreed otherwise, nor entitle travelers to compensation claims.


3.18 Travel insurance is mandatory. De-ruimte strongly recommends travelers have adequate travel, baggage, accident, health, and cancellation insurance. If insurance is arranged elsewhere, all relevant details for effective assistance must be provided to info@de-ruimte.net. Proper insurance is essential.


ARTICLE 4 PAYMENTS

4.1 Payments due must be made within the specified period unless stated otherwise.


4.2 De-ruimte is authorized to collect payments, if necessary on behalf of the relevant service providers.


4.3 If payment is not made or is late, the traveler is in default and agreements are considered canceled. De-ruimte may charge cancellation fees as per Article 3.13 or deduct them from received deposits.


4.4 Any refunds will be made exclusively to the traveler.
